Boon Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Nita Labs, trading as Boon ("Boon", "we", "us", or "our"). They govern your access to and use of the Boon Android application and related support services (together, the "Service").
By downloading, accessing, or using the Service, you agree to these Terms and the Boon Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of legal majority where you live, and have capacity to enter into these Terms. You must use the Service only in accordance with applicable law.
2. What Boon Is and Is Not
Boon is an informational driver-assistance and business-records tool. It can evaluate information displayed in an incoming driver-app offer and help you record earnings, expenses, shifts, mileage, and tax estimates.
Boon is not:
A transport, dispatch, booking, payment, or driver-platform service.
Affiliated with, endorsed by, or sponsored by Uber, Bolt, Lyft, DoorDash, Uber Eats, Just Eat, or any other third-party platform.
An automation or account-management tool.
Financial, tax, accounting, legal, or professional advice.
A guarantee of profitability, demand, earnings, tax treatment, or offer accuracy.
Boon reads visible information only. It does not tap, swipe, type, accept, decline, cancel, dismiss, or otherwise control a third-party app on your behalf.
3. Driving Safety
You are responsible for using the Service safely. Do not configure, read, or interact with Boon in a way that distracts you from driving, breaches road-traffic law, or creates a safety risk. You remain responsible for your vehicle, route, driving decisions, and compliance with all laws and platform rules.
4. Third-Party Driver Platforms
Third-party driver platforms control their own apps, policies, account decisions, and terms. Their layouts, offers, and rules can change without notice. You are solely responsible for reviewing and complying with the terms of every platform you use alongside Boon.
We do not represent that Boon is permitted by, compatible with, or risk-free under any third-party platform's terms. We are not responsible for warnings, suspensions, deactivations, lost opportunities, or other consequences imposed by a third-party platform.
5. Permissions
Boon may request permissions for Accessibility Service, MediaProjection screen capture, notifications, location, camera, and photos or files. You choose which permissions to grant, and you can revoke permissions through Android settings. Some features will not work without the relevant permission.
MediaProjection is only used after you accept Boon's disclosure and Android's own screen-capture confirmation. It is used to read visible offer information, not to operate other apps.
6. Free and Pro Features
Boon may offer a free plan and one or more paid Boon Pro plans. The features, limitations, price, billing period, and trial terms available to you are shown in the App and Google Play at the time of purchase.
Where offered, Boon Free is intended to provide core business-recording tools, such as earnings, expenses, mileage, shifts, and tax estimates. Boon Pro may provide live offer evaluation, the notification overlay, and other driver-performance features. Features may evolve as the Service develops.
7. Trials, Subscriptions, and Payment
If you start a Pro trial, the App and Google Play will show the trial length, price after the trial, and billing period before you confirm. Unless you cancel before the trial ends, the subscription may convert to a paid subscription in accordance with the Google Play terms shown to you.
Payments, renewals, cancellations, refunds, and restore-purchase requests are processed through Google Play and RevenueCat. We do not receive or store your full payment-card details.
You can manage or cancel a Google Play subscription through your Google Play account. Refund eligibility is determined by Google Play's applicable policies and consumer law. We may change prices or plans for future billing periods with any notice required by applicable law and Google Play rules.
8. Tax Estimates and Reports
Boon's tax estimates, mileage calculations, expense categorisation, and accountant-style PDF exports are informational summaries only. They are not an HMRC tax return, an accountant's report, professional advice, confirmation that an expense is allowable, or a guarantee that a deduction or tax calculation will be accepted.
You are responsible for checking all figures, keeping original records and receipts, determining allowable expenses, filing returns, making payments, and obtaining professional advice where needed.
9. Your Account and Data
You are responsible for keeping your account secure and for activity performed through it. Tell us promptly if you believe your account has been accessed without permission.
Your business records are stored locally on your device. You are responsible for maintaining any backup you need. Deleting local data, clearing app data, or uninstalling the App may permanently remove data stored on the device.
10. Acceptable Use
You must not:
Use the Service unlawfully or in breach of another person's rights.
Interfere with the Service, its security, or its infrastructure.
Try to access another user's information or our systems without authorisation.
Reverse engineer, decompile, modify, distribute, sell, rent, lease, or sublicense the App except where applicable law does not permit restriction.
Use the Service to create or operate a competing service using our protected materials.
Misrepresent your identity when contacting support.
We may suspend or terminate access where we reasonably believe you have breached these Terms, committed fraud, created a security risk, or where required by law.
11. Intellectual Property
The App, Service, software, design, graphics, names, logos, and content are owned by Nita Labs or its licensors and protected by applicable intellectual-property law. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on a device you own or control.
12. Consumer Rights and Statutory Guarantees
Under the Consumer Rights Act 2015, you are entitled to digital content that is of satisfactory quality, fit for a particular purpose, and as described. Nothing in these Terms excludes or limits your statutory consumer rights under UK law.
13. Availability and Changes
We may update, modify, suspend, or discontinue parts of the Service. We will use reasonable efforts to give notice of material changes where appropriate, but we do not guarantee that every feature will always be available or unchanged.
14. Disclaimers
The Service is provided "as is" and "as available" to the fullest extent permitted by law. We do not guarantee that it will be uninterrupted, secure, error-free, available on every device, or accurate in every situation.
Offer reading and calculations can be affected by device performance, Android behaviour, permissions, screen layouts, third-party app changes, connectivity, and data entered by you. You remain responsible for deciding whether to accept or decline an offer and for independently checking your earnings, expenses, mileage, and tax obligations.
Nothing in these Terms excludes or limits any right that cannot lawfully be excluded or limited, including mandatory consumer rights.
15. Liability
To the fullest extent permitted by law, Boon is not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, including loss of profits, revenue, opportunity, goodwill, or data, arising from use of or inability to use the Service.
Subject to the paragraph above and to any liability that cannot lawfully be limited, Boon's total liability arising from the Service or these Terms will not exceed the amount you paid to Boon for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
16. Termination
You may stop using the Service at any time. You may request deletion of your account by contacting us. We may suspend or end the Service or your access where permitted by these Terms or law. Sections that by their nature should survive termination, including intellectual property, disclaimers, liability, and dispute provisions, will survive.
17. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction, subject to mandatory rights you may have as a consumer to bring a claim in your jurisdiction of residence.
Before starting formal proceedings, please contact us so we can try to resolve the issue informally.
18. Changes to These Terms
We may update these Terms when the Service, law, or our business changes. If a change is material, we will provide reasonable notice through the App or another appropriate method and update the date at the top of these Terms. If you continue to use the Service after the updated Terms take effect, you accept them to the extent permitted by law.
